Welcome to tickets.holoapac.live (the Website). The Website is an event ticketing platform for events organised by HoloAPAC Offkai (the Services).

The Website is operated by HoloAPAC Offkai (ABN 87 713 895 325). Access to and use of the Website, or any of its associated products or services, is provided by HoloAPAC Offkai. Please read these terms and conditions (the Terms) carefully. By using, browsing and/or reading the Website, you signify that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website or any of the Services immediately.

HoloAPAC Offkai reserves the right to review and change any of the Terms by updating this page. When HoloAPAC Offkai updates the Terms, it will provide notice of such changes via email to registered users and through a prominent notice on the Website at least 30 days before the changes take effect. Changes to the Terms will become effective 30 days after the date of notification, unless a longer period is required by law. Users who continue to use the Website after the notice period will be deemed to have accepted the updated Terms. We recommend you regularly review and keep a copy of the Terms for your records.

Acceptance of the Terms

You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by HoloAPAC Offkai in the user interface.

Tickets and Event Terms

  • Tickets purchased through the Website are subject to availability and cannot be transferred, resold, or modified without HoloAPAC Offkai’s express permission.
  • Each ticket admits only one person to the event. The ticket holder must comply with all venue rules and regulations.
  • HoloAPAC Offkai reserves the right to cancel or postpone events due to unforeseen circumstances. In such cases, ticket holders will be notified and provided with information about refunds or rescheduling.

Refund Policy

Refunds will be provided in the following circumstances:

  1. Event cancellation by HoloAPAC Offkai
  2. Significant change in event date, time, or venue
  3. As required by Australian Consumer Law

Info

  • Refund requests must be submitted within 7 days of the announcement of cancellation or change.
  • Processing time for refunds may take up to 14 business days.

No refunds will be provided for:

  • Change of mind
  • Failure to attend the event
  • Late arrival to the event

Payment and Ticketing

  • All ticket payments are processed through Stripe. In purchasing tickets, you warrant that you have read, understood and agree to be bound by Stripe’s terms and conditions.
  • Ticket prices are listed in Australian Dollars (AUD) and include GST where applicable.
  • You acknowledge and agree that where a payment is declined or returned by your financial institution, you are liable for any costs, including banking fees and charges.
  • HoloAPAC Offkai reserves the right to change ticket prices and availability at any time without notice.
  • Where ticket prices are increased after purchase, HoloAPAC Offkai will honour the original purchase price for all tickets purchased prior to the price change.

Event Attendance and Liability

  • Entry to events is subject to the presentation of a valid ticket. HoloAPAC Offkai reserves the right to refuse entry or remove any person from the venue.
  • Ticket holders attend events at their own risk. HoloAPAC Offkai is not liable for any loss, injury, or damage that may occur while attending an event.
  • To the maximum extent permitted by law, ticket holders waive all rights to claim against HoloAPAC Offkai for any indirect, consequential, special, or exemplary damages arising from or related to event attendance, including but not limited to personal injury, property damage, or disappointment with the event experience.
  • HoloAPAC Offkai is not responsible for:
  • Personal belongings brought to the event
  • Transport to and from the event
  • Any changes to the event program, timing, or featured performers

Event Cancellation and Changes

HoloAPAC Offkai reserves the right to:

  1. Add, withdraw, reschedule or vary advertised events
  2. Vary advertised programs, prices, venues, seating arrangements and audience capacity
  3. Make changes to event details as required by circumstances

In the event of cancellation or significant changes, ticket holders will be notified via the contact details provided during ticket purchase. HoloAPAC Offkai is not liable for any additional expenses incurred by ticket holders due to event changes or cancellations.

Copyright and Event Content

  • All content on the Website, including but not limited to event descriptions, images, logos, and promotional materials, is protected by copyright under Australian law and international treaties.
  • Unauthorized use of tickets, including reproduction, alteration, or resale, is strictly prohibited and may result in entry being refused.

Photography and Recording Rights

  • By attending the event, you acknowledge and agree that:

    • HoloAPAC Offkai and its authorized representatives may photograph, film, and/or record you during the event;
    • You grant HoloAPAC Offkai and its authorized representatives the perpetual, worldwide right to use, reproduce, modify, distribute, and publicly display such photographs, recordings, and footage containing your image or likeness for promotional, marketing, archival, or other legitimate business purposes;
    • This grant of rights is made without any expectation of compensation or additional consideration;
    • HoloAPAC Offkai will exercise these rights in accordance with applicable privacy laws and in a manner that respects attendee dignity.

  • Attendee Photography and Recording:

    • You may take photographs and recordings for personal, non-commercial use during the event;
    • Such photography and recording must not interfere with the event, performers, or other attendees' enjoyment;
    • Any commercial use, broadcast, or public distribution of your photographs or recordings requires express written permission from HoloAPAC Offkai;
    • Specific venues or events may have additional restrictions on photography or recording, which will be communicated in advance and must be followed.

  • HoloAPAC Offkai reserves the right to:

    • Impose additional restrictions on photography and recording at specific events;
    • Request the deletion of any photographs or recordings that violate these terms;
    • Remove attendees who do not comply with photography and recording restrictions.

  • Image Removal Requests:

    • If you wish to have your image removed from any photographs or recordings taken by HoloAPAC Offkai or its authorized representatives, please contact us directly with your request;
    • For photographs or recordings published by other attendees, please contact the respective photographer or publisher directly;
    • While we will make reasonable efforts to accommodate removal requests, please note that it may not be possible to remove images from all contexts, particularly if they have been widely shared or published.

Privacy and Data Protection

  • Personal information collected during ticket purchases will be handled in accordance with our Privacy Policy and Australian privacy laws.
  • By purchasing tickets, you consent to your personal information being collected and used for event administration, security, and contact tracing purposes where required by law.
  • Contact details provided during ticket purchase may be used to notify you of important event information, changes, or cancellations.
  • You have the right to access, correct, or request deletion of your personal information by contacting us, and we will implement reasonable security measures to protect your data from unauthorized access or disclosure.

Venue and Jurisdiction

Events and ticket sales are intended for residents of Australia. In the event of any dispute arising out of or in relation to ticket purchases, event attendance, or the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Victoria, Australia.

Governing Law

These Terms are governed by the laws of Victoria, Australia. Any dispute relating to ticket purchases, event attendance, or these Terms shall be governed by Victorian law, without reference to conflict of law principles. This includes compliance with all applicable live entertainment and ticketing regulations.

Consumer Rights

Nothing in these Terms affects your statutory rights under Australian Consumer Law. Where any term appears to conflict with your consumer rights, those rights will prevail to the extent of any inconsistency. For events cancelled or significantly changed, you may be entitled to a refund under Australian Consumer Law, in addition to any rights specified in these Terms.
